Hello, everyone! Welcome to our special nomination edition of the live blog.
-
We are expecting an announcement at 11 am. All reports point toward Merrick Garland of the DC Circuit.
-
What's the likelihood that Srinivasan was POTUS's first choice but Sri turned it down so as not to be cannon fodder? Seems like Sri would have been a better nominee from a political point of view.
-
What a great present from the Prez to Lyle Dennison for his 85th birthday--a SCOTUS nomination!!!
-
From our review of potential nominees in 2010, Judge Garland: www.scotusblog.com
-
Does President Obama expect Garland to make the kind of progress in the Senate that another nominee couldn't?
-
If Obama nominates Garland, and the senate does not consider his nomination, would the next president (assuming its a democrat) be morally obliged to renominate him, or could they go for a more liberal alternative?
-
If Clinton wins the general, do you think Obama would withdraw his nomination? (Assuming no confirmation by then)
-
How dare the Senate majority leader declare that the American people only have a say in who is nominated, if they abscond their constitutionally derived job duties and let a (hypothetical) next Republican POTUS make the "pick." Even Drumpf wants to "pick"...this is a careful choice, and not one that should be made based on rightwing v leftwing ideology.
-
If Judge Garland is confirmed, who are the likely candidates to be nominated for the open spot on the DC Circuit?
-
How liberal is Garland compared to Breyer, Ginsburg, Sotomayor and Kagan?
-
Given that Garland is pretty close to the center, if this doesn't go through the Senate before the election, and the Democrats win, what are the chances that Clinton will nominate someone other than Garland?
-
Obviously to the left of Scalia, what issues would Garland help change if successfully confirmed?
-
If Garland were to get on the Court, would he take the "swing justice" spot away from Kennedy?
-
Besides his track record and credentials, do you think Justice Garland's age played a part in Obama's selection, in that Republicans might be more comfortable confirming someone who won't be on the Court for the next 30 or 40 years?
-
Startling fact from Tom's 2010 post, given the length of Garland's tenure: "The Supreme Court has not granted cert. in any case in which [Garland] wrote the court of appeals' opinion." Assuming that hasn't changed since 2010, it's a strong point for Dems to push: a conservative Supreme Court has never found even one occasion to question his work.
-
In the current political climate, with Trump's having taken the lid off of "politically incorrect" discourse, do you think anyone would dare (explicitly or impliedly) make anything of the fact that Garland would be a fourth Jewish Justice?
-
Does this pick suggest that the White House actually believes that it can "force" a confirmation? In other words, if they truly thought that the GOP would stonewall ANY nominee, would the President have appointed someone more liberal/young/etc.?
-
there was a lot of speculation Obama would pick a woman or a person of color to excite the base and make it more difficult for Republicans to reject that person. do you think his choice not to do that will hurt him?
-
Once @SCOTUSnom is confirmed and court balance tipped, can Obama name a new chief justice?
-
I can now confidently predict the nominee will be Garland.
-
Among other places, I'm sure, you can see the announcement live here: www.youtube.comby Kevin Russell via YouTube 3/16/2016 3:05:51 PM

Obama says he has to set aside "short term expediency." Perhaps a nod to not making a "first" pick that would help the Democrats in the election.
-
"“This is not a responsibility I take lightly—it’s a decision that requires me to set aside short-term expediency or narrow politics”
-
How do SCOTUS advocates prepare to present certain cases to someone like Garland who doesn't have much of a record on some issues? Would his confirmation change their tactics until there's a more established record?
-
"Today I am nominating Chief Judge Merrick Brian Garland to join the Supreme Court."
-
How would Garland affect the fee payer status represented in Friedrichs?
-
Garland sold his comic book collection to help pay for law school.
-
Any chance of a bipartisan agreement in which Garland is confirmed to the Supreme Court and Obama nominates a conservative to the D.C. Circuit -- someone like Paul Clement or Peter Keisler or Miguel Estrada?
-
President notes that Garland clerks for (Republican) Pres. Eisenhower appointees. (Doesn't mention that one, Brenan, was super liberal).
-
Basic question: If confirmed, does he recuse himself from cases that he previously considered on the Court of Appeals?
-
In 1989, just months after making partner, Garland returned to public service going after "corrupt politicians and violent criminals" as a prosecutor
-
How much of a role do you think Heller played in the choice, and will play in the confirmation fight to come?
-

What are some possible objections to Garland that Republicans might bring up?

Garland on Oklahoma City bombing work: "The most important thing I have ever done in my life"
-
President is
throwing Republicans' nice statement during Garland's DC Cir. nomination back in their faces. -
If 23 Senators voted against Garland when he was nominated for the D.C. Circuit, wouldn't it be very easy for all of the Senators who voted against him last time (and all of the other Republicans) to justify a refusal to vote for him this time? It seems like that would have been much harder to do with someone who was confirmed unanimously.
-
Does the selection of an older nominee (Garland is 63) increase the likelihood of eventual Senate approval?
-
President is quoting John Robert's nice statements about Garland.
-
It is an unexpected but very excellent appointment. The President clearly wants to make this not about politics but about making it the strongest possible nomination. He wants conversation to be about merit. Garland is the pure merit-based appointment.
