What are the odds that a President Trump would keep him as the nominee?

It is true the nomination does not diversify the Court in terms of religion, geography, and law school. But, the response from the President is that he picked the strongest candidate he could find.

If Garland is confirmed, it seems like Srinivasan becomes a bit less likely as the next pick, especially if Ginsburg is being replaced. Srinivasan would be a) a shift rightward and b) a shift maleward.

What is Garland's temperament during oral argument? Toward the Scalia side or the Thomas side?

They end up looking "more liberal" because of what they are being compared with. They are reacting to or responding to the opinions from other justices, such as Justices Scalia and Thomas, that tend to be "more conservative," by comparison, with the general population of federal judges.

Previous Supreme Court Justices have disappointed their appointing President's parties in the past (see Souter, Kennedy). With Kagan and Sotomayor clearly following liberal ideals, is there any sense whether Garland is more in the "crapshoot" bucket (as previously noted) or "left of center moderate" that he's expected to be?

Given the combo of respect, reasoning, and only slight lean-left; is it possible Garland could potentially pull Kennedy & Roberts to the left in some cases, as well?

I think what you see is what you get. The thing about a "moderate" judge is that he/she tends to be more difficult to predict than someone who is extreme either to the right or left.

Why is it that with all the law schools in the country, only Harvard & Yale are represented on the Court? Seems a little elitist as there are many great schools that turn out great lawyers & judges.

Does he have to be renominated if a new Senate (potentially with a dem majority) takes over on 1/3, a few weeks before the end of Obama's term?

Not only Harvard and Yale, but usually from a coast and either a Catholic or Jew. Garland is from Chicago, so at least he breaks one tradition.

Do you think that Garland will recuse himself and/or not be available to judge anything at the DC Circuit (that he hasn't already started) so that he won't have to recuse himself once on SCOTUS?

I wonder if Senate Republicans, facing a TRum-Cllinton general election, will be more amenable to considering a Garland nomination now than someone Clinton might nominate next January.....
