Which is to say that Tom will join us shortly. Amy is at the Court this morning covering Lozano v. Alvarez.
It will be interesting if we start to get some more controversial opinions, though it's not very likely.
After today, we will probably get opinions again next Monday, then not again until the Court returns from its Winter Recess in January.
It would be surprising if the Court was finished with one of the November cases, but it is not inconceivable.
One opinion: 12-609, Kansas v. Chever.
Supreme Court of Kansas' decision is vacated per Sotomayor for unanimous court.
Amy will have the opinion analysis for us.
The holding of Buchannon is reaffirmed and applies to permit the prosecution to introduce the rebuttal evidence from a court ordered mental investigation.
The case is remanded for further proceedings.
In the Supreme Court, the defendant's principal argument was that he should be allowed to prevail on other grounds, so it will be interesting to study what the Justices have left open.
