We thought we were going to be here at the Court today covering Gloucester County School Board v. G.G., but instead we have just one case -- Lee v. United States, a "crimmigration" case.
-
How do you know ahead of time which opinions will come out today?
-
Most likely to be decided sooner rather than later?
-
For those of you who are new here, the number of boxes is a rough proxy for the number of opinions we expect. Fewer boxes generally equals fewer opinions.
-
Amy is getting in line for the first (possibly only?) opinion now.
-
Moore v Texas is the only opinion, by Justice Ginsburg, 5-3
-
Decision of Texas Court of Criminal APpeals vacated and remanded
-
This is the case in which the death row inmate is intellectually disabled
-
Amy Howe will have our coverage of Moore v. Texas. Here is the opinion. www.supremecourt.gov
-
"Not aligned with the medical community's information, and drawing no strength from our precedents," the factors on which the Texas court relied "create an unacceptable risk that persons with intellectual disability will be executed."
-
So the factors cannot be used as the Texas court used them to restrict who qualifies as intellectually disabled.
-
Court says that whether someone is disabled should be "informed by the views of medical experts."
-
"That instruction cannot sensibly be read to give courts leave to diminish the force of the medical communitsy's consesnsus."
