Justice Kennedy has the opinion for a unanimous Court. Thomas concurred.
The Eighth Circuit is vacated and remanded.
The holding: A favorable ruling on the merits is not a necessary predicate to find that a defendant is a prevailing party.
This is a Title VII case.
This is for purposes of an attorney's fees award.
That is, once again, all of the opinions for the day.
So we will have to wait for the next opinion announcement day for Foster v. Chatman, Sanchez Valle, and all of the other cases our readers have asked about.
The Court is scheduled to sit next Monday, May 23, for a "non-argument" session. Presumably they will release opinions then (and we would not expect them before then), but we don't know yet for sure. As soon as we do know, we will let you know.
Monday is the next opinion day. If there are additional opinion days next week, the Court will make that known in advance.
