Once again, we are waiting to see whether the Court acts on either the gun rights petitions or the qualified immunity petitions.
Good morning, all. I'm feeling pretty good, if a bit sore, after getting to play pickup hockey for the first time in more than three months as ice rinks in northern Virginia opened over the weekend, with safety protocols in place of course.
There were also some petitions relisted for the first time that seem like likely candidates for grants sooner, rather than later -- two immigration cases involving the right to periodic bond hearings, a pair of cases involving arbitration, and a case involving the intent standard for a conviction for making a threat.
About to go to "refresh" mode to wait for orders.
Sorry. Having some technical issues. Two grants, one involving immigration and the other involving arbitration.
First is 19-897, Albence v. Chavez, involving which provision of immigration law governs detention of non-citizen whose removal order has been reinstated & who is seeking withholding of removal.
The Court appears to have denied many of the qualified immunity AND Second Amendment cases.
I see Brennan v. Dawson, Dawson v. Brennan, Gould v. Lipson, Ciolek v. NJ, Worman v. Healey, Malpasso v. Pallozzi, Culp v. Raoul, Anderson v. Minneapolis, and more all in the denied list.
There's a dissent from the denial of cert in the Baxter v. Bracey qualified immunity case by Justice Thomas.
Also denials in Mance v. Barr, Cheeseman v. Polillo.
The Court has denied review in US v. California, the government's challenge to California's "sanctuary state" law. Thomas and Alito would have granted.
There is a per curiam opinion in Andrus v. Texas, a capital case.
A very busy orders list to digest, to say the least.
The court grants Andrus' petition for review and sends the case back "for further proceedings not inconsistent with this opinion." The court concludes that the "record makes clear that Andrus has demonstrated counsel's deficient performance under" Strickland v. Washington, but that the state's intermediate appellate court "may have failed properly to engage with the follow-on question whether Andrus has shown that counsel's deficient performance prejudiced him."
Zadeh is also denied. Corbitt v. Vickers is denied, as is Wilson v. Cook County and Hunter v. Cole.
I *think* that all of the Second Amendment cases and QI cases have been denied, but perhaps Kal or Edith could confirm?
Justice Alito dissents from the decision in Andrus, joined by Thomas and Gorsuch.
Thomas dissents from the denial in Rogers v. Grewal, the NJ carry permit case, joined by Kavanaugh.
(I thought that Rogers was one of the best candidates for a grant, FWIW.)
In Baxter v. Bracey, Justice Thomas dissents (alone) from the denial of review.
And now I have made my first pass through the order list.
Well, that was all unexpected. That was definitely one of the more momentous order lists I've seen in a while.
Remember, once opinions start, we expect a 10-minute interval between opinions. That is, if we had more than one.
